Training Release & Policies

ASSUMPTION OF RISK
The user (“you”) acknowledges that you are voluntarily participating in dog training services (the “Services”) provided by Extraordinary Canines Inc., Megan Brooking, and/or their instructors, employees and assistants (“Extraordinary Canines”), and have been informed by Extraordinary Canines of the potential dangers arising from such Services. You represent that you are the owner or guardian of the dog(s) identified in this Agreement. You acknowledge that dogs are unpredictable animals with their own will and drives, and therefore, regardless of training, handling, or environmental circumstances, Extraordinary Canines cannot protect against every potential injury, risk or accident that may occur to you or any other person participating or engaging in the Services or that is on the property where the Services are taking place (the “Premises”), or to your dog(s), or any such other dog(s) participating in the Services, either before, during, or immediately after the provision of the Services while such parties are located in or around the Premises. These may include, without limitation, risk of illness, falls, bites and injury through contact with other people or dogs who may or may not be participants in the Services. You understand and acknowledge that such risks are inherent and, despite Extraordinary Canines’ best efforts, cannot be eliminated. By entering this Agreement you hereby agree to assume all resulting risk and liability arising from your participation in the Services, including, but not limited to that concerning your dog and your family members/guests who may accompany you during your participation in the Services, including the associated risks of bodily injury, death or property damage while participating in activities under the supervision of Extraordinary Canines.

RELEASE OF LIABILITY
You agree that in consideration for being permitted to participate in the Services provided by Extraordinary Canines, you, and your heirs, next of kin, executors, and personal representatives (collectively, the “Releasors”), assume the entire risk associated with participating in such an activity and waives, releases, discharges and covenants not to sue Extraordinary Canines, its directors, officers, members, managers, employees, agents, sponsors, organizers, volunteers or other representatives, their successors and/or assigns (collectively, “Releasees”), from any and all liability to Releasors for any loss, harm, damage, claim, injury (including death) or accident to the person or property of yourself, your dog, and any other persons accompanying you at the dog training, including any minor children, arising out of or related to participating in dog training or using any facilities or equipment of Extraordinary Canines, even if caused by any negligent act or omission of Releasees. Nothing herein is intended to release Releasees from any harm, injury, claim or damage caused by intentional misconduct.

INDEMNIFICATION
You agree that you are and will be responsible for your conduct and the conduct of your dog(s) and other persons who may be accompanying you (including minor children) at all times. You agree to indemnify and hold harmless Extraordinary Canines, its directors, officers, members, managers, employees, agents, sponsors, organizers, volunteers and other representatives (“Extraordinary Canines Personnel”), from any and all claims of injury (including death), loss, cost, expenses, or damage to persons, dogs, or property caused by the acts or omissions of you, your dog, and any other persons accompanying you, including any minor children, during the course of training or related activities, as well as by the conduct of your dog under your own care either as a result of following training instructions, or otherwise. This provision applies whether the claims are made by you, members of your family, your accompanying guests, Extraordinary Canines Personnel, or any other third party.

NO GUARANTEE OF RESULTS
You recognize that the role you play in your dog(s)’s learning process is integral to achieving your desired results. You acknowledge and agree that Extraordinary Canines, despite its best efforts, cannot guarantee that your dog will achieve the desired level of training. You hereby acknowledge and accept that Extraordinary Canines makes no representation, guarantee or promise, implied or express, that any training received from Extraordinary Canines will cure a dog of any dangerous propensities or other undesirable habits or behaviours. You further understand that the recommendation of any other product or service by Extraordinary Canines is not a guarantee of satisfaction with that product or service.

PARTICIPANT RIGHTS
You have the right to refuse any part of the Services, including the functional assessment, training class and/or behavior change program, as well as any particular training exercises that you feel are inappropriate. Extraordinary Canines recommends that you openly communicate with its trainers to ensure that the behavior modification or training program may be adjusted to reflect your wishes. You have the right to ask further questions and seek clarification on all relevant details regarding any assessment or training exercise.

PHOTO RELEASE
By checking the box marked ‘I Agree’, you hereby grant a revocable license to Extraordinary Canines to permit Extraordinary Canines to publish in print, electronic, or video format the likeness or image of you and/or your dog(s). You hereby agree to release all claims against Extraordinary Canines with respect to privacy rights, publicity rights, copyright ownership and publication, including any claim for compensation related to use of the materials. Should you wish to exclude any or all uses of the likeness or image of you and/or your dog from such permission, we request that you express such wishes in writing to Extraordinary Canines at your earliest convenience.

SAVING CLAUSE
You hereby expressly agree that the assumption of risk, release, waiver, and indemnity provisions contained in this Agreement are intended to be as broad and inclusive as permitted by applicable law, and that if any portion thereof is held invalid, you agree that the remaining provisions will continue in full force and effect.

REFUND AND CANCELLATION POLICY
If you fail to give at least 24 hours’ cancellation notice, or are not present at the time of a scheduled private training appointment, fees associated with such appointment will remain due or will not be refunded. For Training Packages, the session will be counted as a completed session. Cancellation of scheduled training appointments more than 24 hours in advance may incur a cancellation fee of $15 as determined by Extraordinary Canines.

Withdrawal from a group class, including K9 Nose Work® classes, maybe be refunded up to 1 week prior to the first class in a series (or the individual class in the case of drop-in classes like Puppy Elements). Withdrawal from a group class less than 1 week prior to the beginning of the first class in a series will not be refunded unless the held spot is filled from a waitlist. Extraordinary Canines is not responsible to provide make-up classes for students who are unable to attend a class in a series.

Registration to group classes reserves a seat for attendance to the class and does not guarantee delivery of services. In the event that you are denied entry to a class due to class requirements you will not be issued a refund (including, but not limited to, not completing required prerequisites, not providing proof of vaccinations, and not meeting age requirements).

In the event that your dog is dismissed from a group class that does not allow for reactive dogs due to your dog’s reactivity a refund will not be offered, however you will be encouraged to attend the class without the dog and practice at home; K9 Nose Work® classes allow reactive dogs.

There is a 30 day refund period for services purchased as part of a package. Packages refunded within the 30 day refund period are subject to a $15 administration fee. In the event that a package has been partially redeemed, Extraordinary Canines will retain the full value for any services that have been redeemed and any discount offered through the purchase of a package will be lost. Extraordinary Canines will retain the full value of any package purchased after 30 days.

By checking the box marked ‘I have read and agree to the terms above’, you declare that you are at least 18 years of age and competent to enter into this Agreement. You acknowledge that you have carefully read this Agreement, understand its contents, and have agreed to be bound by its terms. You specifically understand that this Agreement includes an assumption of the risk of Extraordinary Canines negligence and a release of Extraordinary Canines’ liability.
